Terms of Service

These terms govern your use of Kyn and outline our mutual responsibilities.

Kyn Terms of Service

These Terms govern use of the Kyn website at linklodge.app (the Site) and the Kyn software and related services (the Service). By accessing the Site or creating an account, you agree to these Terms.

Heads-up: Nothing here limits rights that cannot be excluded under the Australian Consumer Law (ACL).

1. What Kyn is

Kyn is a web-based platform that allows businesses to create and manage an embeddable team directory for display on their public website. Through the Kyn dashboard, account holders can add, edit and remove team member profiles, control which profile fields are publicly visible, and generate embed codes for use on their website. Profile updates made in the dashboard are reflected in the embedded directory in real time. Kyn is operated by Dimension 5 Pty Ltd (ABN 161 171 60219), trading as Kyn, and is accessible at teamkyn.app.

2. Key definitions

  • Account — the organisation profile and user logins created for the Service
  • Content — files, links, text, images and other material you upload or publish
  • Directory — a team profile directory you create in Kyn
  • We/us/our — Dimension 5 Pty Ltd trading as Kyn
  • You/your — the person or organisation using the Service

3. Eligibility and accounts

You must be at least 18, able to form a contract, and use the Service for a business purpose.

You are responsible for:

  • providing accurate account details
  • keeping login credentials secure
  • actions taken under your Account

4. Plans, billing and taxes

We use Stripe as our payment processor to process purchases, handle tax, and issue invoices. When you buy a plan, Stripe is an independent controller of your billing data. Their terms and privacy policy apply at checkout.

  • Fees are charged in the currency shown at checkout, on a recurring basis unless cancelled
  • Taxes and government charges are added where required
  • You can cancel any time. Access will continue until the end of the current paid period
  • We may change pricing with prior notice on the Site or by email. Changes apply to future periods

5. Acceptable use

You must use the Service lawfully and reasonably. Do not:

  • upload illegal content, malware or material that infringes others' rights
  • publish sensitive personal information unless you are legally allowed to do so and have consent where required
  • attempt to probe, scan or test the security of the Service
  • interfere with other users' access or the operation of the Service
  • misrepresent your identity or affiliation
  • use the Service to send spam or unsolicited communications

We may suspend or remove Content that breaches these Terms or the law.

6. Your Content

You keep ownership of your Content. You grant us a worldwide, non-exclusive licence to host, store, reproduce and display the Content only to provide the Service and meet legal obligations.

You are responsible for:

  • the accuracy, quality and legality of your Content
  • ensuring you have rights and permissions to publish the Content

Team profile information may be indexed by search engines.

We are not obliged to monitor Content, but we may review or remove Content to meet legal or policy requirements.

7. Our intellectual property

The Site, the Service, and all software, designs and branding are owned by us or our licensors. You receive a limited, revocable, non-transferable licence to use the Service for your internal business purpose while you have an active plan.

Do not copy, modify, reverse engineer, or create derivative works of the Service.

8. Third-party services

The Service integrates with providers we use to operate Kyn, such as hosting, email delivery, file storage/CDN and payments. We don't control third-party services and aren't responsible for their acts or omissions. Your use of third-party services may be subject to their terms.

9. Privacy

Our Privacy Policy explains how we collect and use personal information, including cross-border transfers and regional rights. By using the Service you agree to that policy.

10. Security

We apply reasonable technical and organisational measures, including encryption in transit, access controls and least-privilege practices. No online service is completely secure. You are responsible for maintaining the security of your devices and logins.

11. Availability and changes

We aim for reliable availability but the Service may be interrupted for maintenance, upgrades or events beyond our control. Features may change over time. We may suspend or limit access where needed to protect the Service or comply with law.

If we discontinue a material feature, we'll give reasonable notice where practical.

12. Data retention and export

You can remove Content at any time. After cancellation or termination we may delete or anonymise data following our retention schedule.

We are not a backup service. Keep copies of important files.

13. Beta features and feedback

We may label features as Beta. Beta features are provided "as is" and may change or be withdrawn.

If you give feedback or suggestions, you grant us a free, transferable licence to use that feedback to improve the Service.

14. Suspension and termination

You may cancel at any time through your Account or by contacting support.

We may suspend or terminate access if:

  • you breach these Terms
  • your use creates risk to the Service or others
  • we are required to do so by law

On termination, your licence ends and we may delete Content after a reasonable period, subject to legal duties.

15. Disclaimers

To the extent allowed by law, the Service is provided as is and as available. We don't promise that it will be uninterrupted, error-free or fit for your specific purpose.

Nothing here excludes, restricts or modifies any guarantee, condition or warranty implied by law (including under the ACL) that cannot be excluded, restricted or modified.

16. Limitation of liability

To the extent permitted by law:

  • we exclude liability for indirect, special or consequential loss, loss of profits, revenue, goodwill or data
  • our total liability arising out of or in connection with the Service is limited to the greater of AUD $100 or the amounts you paid to us for the Service in the 12 months before the event giving rise to the liability

If the ACL applies and the Service is not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with a consumer guarantee is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.

17. Indemnity

You indemnify us against losses, costs and liabilities arising from claims that your Content or your use of the Service:

  • infringes any law or third-party right, or
  • breaches these Terms

This indemnity does not apply to the extent caused by our breach of these Terms or the ACL.

18. International users and transfers

We operate from Australia and use providers in other countries. When personal information is transferred, we use lawful safeguards such as the EU Standard Contractual Clauses and the UK Addendum, and for eligible US providers the EU-US/UK-US Data Privacy Framework. From Australia, we follow APP 8.

19. Changes to these Terms

We may update these Terms from time to time. If changes are material, we'll notify you by email or via the Service. The updated Terms take effect on the stated date. If you continue to use the Service after that date, you agree to the changes.

20. Governing law

These Terms are governed by the laws of Victoria, Australia. The courts of Victoria have non-exclusive jurisdiction.
